A Georgia tax power of attorney allows an accountant or other attorney-in-fact to handle a Georgia resident’s tax filing with the Georgia Department of Revenue. Typically this form will be attached to a tax filing when the accountant sends an income tax return in for review.  The taxpayer will be required to complete the form in its entirety and sign where applicable before the accountant will be able to represent them.

Laws

  • Statute – O.C.G.A. § 10-6B-4 (Georgia Power of Attorney Act)
  • Signing Requirements – If the representative is a registered attorney, accountant, CPA, or enrolled agent, the form only needs the taxpayer’s signature. If none of the above titles apply, the form must be witnessed by two witnesses and acknowledged before a notary public.
