A Delaware general power of attorney form has the same powers as the statutory durable document except for the fact that when the principal becomes mentally incompetent, the form becomes void. Both documents, however, provide the principal with an agent who will be able to oversee their finances and make financial decisions on their behalf. The agent must abide by the same laws as any other agent assigned via financial power of attorney documents.

Signing Requirements – The power of attorney form must be signed in the presence of a notary public and one (1) adult witness (§ 49A-105).
